However, although Collarfolk.com strives to provide up-to-date information, Collarfolk.com cannot guarantee the accuracy of information displayed on its web site. It is the responsibility of the third party suppliers/hotel chain and/or the individual property to ensure the accuracy of the photos displayed. collarfolk.com is not responsible for any inaccuracies in the photos, and does not guarantee the availability or price of products or services advertised through the service.

Collarfolk.com shall not be liable for any damages that may be suffered by any traveller/user/pets in connection with the use of the Collarfolk.com site. Any questions, complaints or claims related to such information should be directed to the Supplier.

Collarfolk.com does not sell directly any of the products shown on its site. All products and services are purchased directly from third parties/ suppliers. Collarfolk.com is not responsible for any liability related to the products, their delivery or transaction. Collarfork.com is only an online platform that connects Travellers with Suppliers who have the requisite products for their pets. Similarly, any questions, complaints or claims related to any product, delivery or transaction or any other part of the ordering process should be directed to the appropriate third-party affiliate i.e. the Supplier.

IN NO EVENT SHALL COLLARFOLK.COM BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT. If you are dissatisfied with Collarfolk.com’ Terms and Conditions, your sole remedy is to discontinue your use of this site.

Basic Terms & Conditions

Collarfolk is a Private Limited Company having its registered office at 90/4 Malviya Nagar, Basement, New Delhi 110017, and “you” refers to the individual person/ user / guest/ traveller creating an account with us and/or the customer/guest/traveller booking a reservation though us directly through this website, or indirectly through any of our affiliates/ suppliers through whom we provide services. Collarfolk aims to produce an informative website containing information on pet friendly hotels, travel destinations and a range of products and services for your pet. Collarfolk provides an online platform that connects suppliers who have accommodations that are pet friendly with travellers seeking to book such accommodations and also information regarding a wide range of products and services for your pet (collectively, the “Services”), which Services are accessible at www.Collarfolk.com and any other websites through which Collarfolk makes the Services available (collectively, the “Site”) and as an application for mobile devices (the “Application”). This website is offered to you and is conditioned on your acceptance without modification of the terms, conditions and notices contained herein as they exist at the time the reservation/purchase is made. All use of your account by you and utilization by us of the information related to your account together with reservations/purchases you book through us are subject to the following terms, conditions and notices. By using the Site and Application, you agree to comply with and be legally bound by the terms and conditions of these Terms of Service (“Terms”), whether or not you become a registered user of the Services or a member at the site. These Terms govern your access to and use of the Site, Application and Services and all Collective Content, and constitute a binding legal agreement between you and Collarfolk. Please read carefully these Terms and our Privacy Policy, and which is incorporated by reference into these Terms. If you do not agree to these Terms, you have no right to obtain information from or otherwise continue using the Site or Application. Failure to use the Site and Application in accordance with these Terms may subject you to civil and criminal penalties.

Collarfolk may revise these Traveller Ts&Cs at any time by posting an updated version to this web page. You should visit this page periodically to view the most current Traveller Ts&Cs because they are binding on you.

The site, application and services comprise an online platform through which suppliers may create listings and travellers may learn about and book such listings. You understand and agree that Collarfolk.com is not a party to any agreements entered into between suppliers and travellers, nor is Collarfolk.com a real estate broker, agent or insurer. Collarfolk.com has no control over the conduct of suppliers, travellers and other users of the site, application and services or any listings, and disclaims all liability in this regard.

 


Definitions

“Content” means all means text, graphics, images, music, software (excluding the Application), audio, video, information or other materials that Collarfolk makes available through the Site, Application, or Services, including any Content licensed from a third party, but excluding Member Content.

“Collective Content” means Member Content and Collarfolk.com Content.

“Traveller” means a User/guest who requests a booking of a Listing via the Site, Application or Services, or a User who stays at a Listing and is not the Supplier for such Listing.

“Pets” means dogs, cats and any other domestic pets.

“Supplier” means a Supplier or any individual or company or any entity which creates a Listing via the Site, Application and Services.

“Listing” means an accommodation that is listed by a Supplier as available for booking via the Site, Application, and Services.

“Member” means a person who completes Collarfolk.com account registration process, including, but not limited to Suppliers and Travellers.

“Member Content” means all Content that a Member posts, uploads, publishes, submits or transmits to be made available through the Site, Application or Services.

“Tax” means any sales taxes, service taxes, additional cess or surcharge, value added taxes (VAT), goods and services taxes (GST) and other similar municipal, state and federal indirect or other withholding and personal or corporate income taxes. Certain areas of the Site and Application (and your access to or use of certain aspects of the Services or Collective Content) may have different terms and conditions posted or may require you to agree with and accept additional terms and conditions. If there is a conflict between these Terms and terms and conditions posted for a specific area of the Site, Application, Services, or Collective Content, the latter terms and conditions will take precedence with respect to your use of or access to that area of the Site, Application, Services, or Collective Content.

“Properties” include the hotels, resorts, listings or any other location of which is listed by the supplier on Collarfolk.

 


Eligibility

The Site, Application and Services are intended solely for persons who are 18 years or older. Any access to or use of the Site, Application or Services by anyone under 18 is expressly prohibited. By accessing or using the Site, Application or Services you represent and warrant that you are 18 years or older.

 


Listings And Interaction With Suppliers

1. Suppliers are entirely responsible for all of the information, including images, text and other content, relating to the Listings they offer, for updating them and ensuring (where relevant) that they are correctly translated.
2. If a Traveller finds a Listing in which they are interested, they can send an information request to the Supplier an enquiry stating their name along with any requested information.
3. The Traveller will receive a confirmation from Collarfolk.com once an enquiry has been sent to the Supplier.
4. The Supplier will send the response to the query to Collarfolk which shall be then forwarded as is without any modification to the concerned Traveller.

Payments & Reservations: Use Of The Online Payment System

The Collarfolk Online Payment System is provided on the Site to assist Travellers to make legitimate reservations with Suppliers, and to make payments for those transactions through Collarfolk.com, and for no other purposes.
You confirm that you are at least 18 years of age and possess the legal authority to enter into this agreement and to use the Collarfolk Online Payment System in accordance with these terms and conditions. You also agree that all information supplied by you in using the Site and the Collarfolk Online Payment System will be true and accurate.
Any speculative, false or fraudulent booking is prohibited. You agree that the Collarfolk Online Payment System will only be used to make legitimate reservations or purchases for you or another person for whom you are legally authorised to act. You acknowledge that overuse or abuse of the Collarfolk Online Payment System may result in you being denied access to the system and will render you liable to appropriate penal action.

Pay Online

 With the listings, you will be presented with the option to pay online immediately. If you wish to make a booking, reservation or purchase then you shall select the option to pay online immediately. You will be charged the amount in the Rupees (INR). You shall provide the details of your payment card and the supplier or Collarfolk.com will often have to verify: (i) the validity of the payment card (through a charge of a nominal value that is either refunded within a few days or deducted from the final payment due to the supplier) and, (ii) the availability of funds on the payment card (to be confirmed by the bank issuing your credit card). Collarfolk.com reserves the right to cancel your booking if full payment is not received in a timely fashion.

Prices

The price of the travel services will be as quoted on the Site from time to time, except in cases of obvious error. Prices are liable to change at any time, but changes will not affect bookings already accepted. Despite Collarfolk.com’s best efforts, some of the travel services listed on the website may be incorrectly priced. Collarfolk.com expressly reserves the right to correct any pricing errors on our Site and/or on pending reservations made under an incorrect price. In such event, if available, we will offer you the opportunity to keep your pending reservation at the correct price or we will cancel your reservation without penalty. Collarfolk.com is under no obligation to provide travel services to you at an incorrect (lower) price, even after you have been sent confirmation of your booking.

Acceptable Payment Methods

1. By booking with Collarfolk.com, you authorize Collarfolk.com and its agents to transact with your bank or other payment gateways on your behalf to obtain the necessary information required to process payment, confirm payment, resolve inquiries and billing disputes, and/or as otherwise required to manage the booking.
2. We accept the following payment methods: (i) Credit Cards with MasterCard or Visa branding (ii) American Express Credit Cards (iii) International Debit Cards with Visa or MasterCard branding which your issuer allows you to use to make purchases online; (iv) Net Banking Payment; and (v) Indian Bank Debit Cards issued by an Indian bank. You will not be asked to provide your online banking user name or password to Collarfolk.com. Collarfolk.com does not want any information regarding your Account Access Data and you agree not to provide us with your Account Access Data.
3. Not all payment methods are available to use for all travel services, travel products, or modifications a Traveller may request to their transaction.
3.1. Credit Card
i. Credit cards with MasterCard or Visa branding or American Express Credit Cards may be used when booking online or by phone.
ii. Your bank or card issuer may require the account holder or the person legally authorized to act on behalf of the cardholder to authenticate and approve the payment.
iii. The recording and billing of account activity on your credit card is handled solely by your card issuer.
3.2. International Debit Card
i. International debit cards may be used when online booking or by phone, provided your card issuer permits use of a debit card for online or phone transactions.
ii. Your bank or card issuer may require the account holder or the person legally authorized to act on behalf of the cardholder to authenticate and approve the payment.
iii. Once payment has been authorized it may appear in your account activity within a few days; however, the length of time required for the deduction of funds and recording of account activity is determined by your bank or card issuer.

General Terms Of Payment

1. When you use a Local Payment Method to make payment, you must authenticate and approve payment directly on your financial institution’s website. Upon logging into your account with the applicable Local Payment Methods, you will see the amount you transacted on our Website and you must confirm and authorize the payment for our services. Upon completing approval, you will either be redirected back to our Site, or you must follow the prompts on your financial institution’s website to return to our Site, in order to successfully complete the payment process. We will promptly generate an electronic mail notification to the email address you provided confirming the details of your itinerary. Collarfolk.com, shall not be responsible in any manner whatsoever in the event the email notification fails to be delivered to the email address provided due to any reason which is beyond the control of Collarfolk.com, including without limitation a break down in your internet connection.
2. Price and availability is not guaranteed until the booking is confirmed.
3. If you fail to return to our Site or do not complete the payment process within 20 minutes, your booking will be unsuccessful and your itinerary will be cancelled. We will promptly generate an email notification to the email address you provided that the booking was unsuccessful. Collarfolk.com, shall not be responsible in any manner whatsoever in the event the email notification fails to be delivered to the email address provided due to any reason which is beyond the control of Collarfolk.com, including without limitation a break down in your internet connection.
4. Avenues India Pvt Ltd (CC Avenue) has been authorized to process online payment transactions on behalf of Collarfolk.com. The name CC Avenue will appear as the merchant name associated with your transaction and on the statement provided by your financial institution.
5. Your financial institution may impose an additional fee or other charges to use their payment services, and you are solely responsible for payment for any and all such Payment Servicing Fees. Collarfolk.com, does not determine or assess such Payment Servicing Fees.
6. Payment Servicing Fees, if any, are not included in the purchase price displayed on your itinerary or the receipts provided by Collarfolk.com.
7. If payment is completed, but the booking is not confirmed by us, your funds will not be sent to Collarfolk.com. Instead, CC Avenue will hold the funds and we will request CC Avenue to return such funds to the originating source.
8. Making a successful payment is not a contract, and Collarfolk.com, makes no guarantee that the travel service or product will continue to be available or be available at the same price in the event a booking is not confirmed.
9. Collarfolk.com, shall have no obligation to replace the unconfirmed booking, accept another booking in lieu of the unconfirmed booking, or to compensate you for such unconfirmed booking. Any subsequent bookings will be treated as a new transaction and will require a new and separate payment. No booking information will be carried over from any previous itinerary. No payment made for a prior unsuccessful booking can be applied towards your new booking.
10. In the event modification of an existing booking for which payment was made results in the need to collect additional funds (for example, a rate increase in a Listing whether such room was booked alone or in a package), payment for any such additional funds may only be made by (a) a credit card with MasterCard or Visa branding or American Express credit cards; or (b) by an international debit card, provided your card issuer permits use of a debit card for online or phone transactions. The payment types identified in the preceding sentence must be used to pay any such additional funds, regardless of the original form of payment for such booking.

Personal And Non Commercial Use Limitation

1. This Site is for your personal and non commercial use. The content and information on this Site (including, without limitation, price and availability of travel services), as well as the infrastructure used to provide such content and information, is proprietary to Collarfolk.com or its suppliers and providers. Accordingly, as a condition of using this Site, you agree not to use this Site or its contents or information for any commercial or non-personal purpose (direct or indirect). While you may make limited copies of your travel itinerary (and related documents) for travel or services purchased through this Site, you agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from this Site.
2 . In addition, whether or not you have a commercial purpose, you agree not to:
2.1. access, monitor or copy any content or information of this Site using any robot, spider, scraper or other automated means or any manual process for any purpose without express written permission of Collarfolk.com; or
2.2. violate the restrictions in any robot exclusion headers on this website or bypass or circumvent other measures employed to prevent or limit access to this Site; or
2.3. take any action that imposes, or may impose, in the discretion of Collarfolk.com, an unreasonable or disproportionately large load on the Collarfolk.com infrastructure; or
2.4. deep-link to any portion of this Site (including, without limitation, the purchase path for any travel services) for any purpose without express written permission of Collarfolk.com

Liability Disclaimer

1. The information, software, products, and services published on this Site may include inaccuracies or typographical errors. In particular, Collarfolk.com does not guarantee the accuracy of, and disclaim liability for inaccuracies relating to the Listing and other supplier photographs, hotel property, cruise, automobile and other product descriptions and lists of Listing hotel amenities and other product descriptions displayed on this website, much of which information is provided by the respective suppliers. Listing ratings displayed on this Site are intended as only general guidelines, and Collarfolk.com does not guarantee the accuracy of the ratings. Changes are periodically added to the information herein. Collarfolk.com, and/or their respective suppliers may make improvements and/or changes on this Site at any time.
2. Collarfolk.com is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. Collarfolk.com has no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond their direct control, and they have no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority.
3. In no event shall Collarfolk.com be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with, the use of this Site or with the delay or inability to use this Site, or for any information, software, products, and services obtained through this Site, or otherwise arising out of the use of this Site, whether based on contract, tort, strict liability, or otherwise, even if Collarfolk.com have been advised of the possibility of damages.

Damage To Listings

1. As a Traveller you are responsible for leaving the Listing in the condition it was at arrival. The Traveller acknowledges and agrees that, as a Traveller, they are responsible for their own acts and omissions and are also responsible for the acts and omissions of any individuals, pets who they invite to, or otherwise provide access to, the Listing. In the event that a Supplier claims otherwise and provides evidence of damage, including but not limited to, photographs, the traveller agrees to pay the cost of replacing the damaged items with equivalent items. The Traveller agrees that the cost of any damage to the listing maybe deducted by the Supplier from the security deposit or the credit card of the Traveller on the file of the Supplier. If the Supplier is unable to charge the credit card on file or otherwise collect payment from traveller, the traveller agrees to remit payment for any damage to the Listing to the applicable Supplier.

See Collarfolk’ Privacy Policy and for information and notices concerning Collarfolk’ collection and use of your personal information.

Application License

Subject to your compliance with these Terms, Collarfolk grants you a limited non-exclusive, non-transferable license to download and install a copy of the Application on a single mobile device or computer that you own or control and run such copy of the Application solely for your own personal use.

Collarfolk Content License

Subject to your compliance with the terms and conditions of these Terms, Collarfolk grants you a limited, non-exclusive, non-transferable license, to (i) access and view any Collarfolk Content solely for your personal and non-commercial use. You have no right to sublicense the license rights granted in this section.
2. You will not use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, publicly perform, transmit, broadcast or otherwise exploit the Site, Application, Services, or Collective Content, except as expressly permitted in these Terms. No licenses or rights are granted to you by implication or otherwise under any intellectual Property rights owned or controlled by Collarfolk or its licensors, except for the licenses and rights expressly granted in these Terms.

The Site, Application and Services may contain links to third-party websites or resources. You acknowledge and agree that Collarfolk is not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by Collarfolk of such websites or resources or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources or the Content, products or services on or available from such websites or resources.
Some portions of the Collarfolk Platform implement Google Maps/Earth mapping services, including Google Maps API(s). Your use of Google Maps/Earth mapping is subject to Google’s terms of use, located at,___________________.

Proprietary Rights Notices

All trademarks, service marks, logos, trade names and any other proprietary designations of Collarfolk used herein are trademarks or registered trademarks of Collarfolk. Any other trademarks, service marks, logos, trade names and any other proprietary designations are the trademarks or registered trademarks of their respective parties.

Feedback

1. We welcome and encourage you to provide feedback, comments and suggestions for improvements to the Site, Application and Services. You may submit Feedback by emailing us at hello@Collarfolk.com. You acknowledge and agree that all Feedback will be the sole and exclusive property of Collarfolk and you hereby irrevocably assign to Collarfolk and agree to irrevocably assign to Collarfolk all of your right, title, and interest in and to all Feedback, including without limitation all worldwide patent, copyright, trade secret, moral and other proprietary or intellectual Property rights therein. At Collarfolk’s request and expense, you will execute documents and take such further acts as Collarfolk may reasonably request to assist Collarfolk to acquire, perfect, and maintain its intellectual property rights and other legal protections for the Feedback.

Termination And Collarfolk Account Cancellation

We may, in our discretion and without liability to you, with or without cause, with or without prior notice and at any time: (a) terminate these Terms or your access to our Site, Application and Services, and (b) deactivate or cancel your Collarfolk Account. Upon termination we will promptly pay you any amounts we reasonably determine we owe you in our discretion, which we are legally obligated to pay you. In the event Collarfolk terminates these Terms, or your access to our Site, Application and Services or deactivates or cancels your Collarfolk Account you will remain liable for all amounts due hereunder. You may cancel your Collarfolk Account at any time via the “Permanently delete my account” feature of the Services. Please note that if your Collarfolk Account is cancelled, we do not have an obligation to delete or return to you any Content you have posted to the Site, Application and Services, including, but not limited to, any reviews or Feedback.

IF YOU CHOOSE TO USE THE SITE, APPLICATION AND SERVICES YOU DO SO AT YOUR SOLE RISK. NOTWITHSTANDING COLLARFOLK’ APPOINTMENT AS THE LIMITED AGENT OF THE SUPPLIERS FOR THE PURPOSE OF ACCEPTING PAYMENTS FROM TRAVELLERS ON BEHALF OF THE SUPPLIERS, COLLARFOLK EXPLICITLY DISCLAIMS ALL LIABILITY FOR ANY ACT OR OMISSION OF ANY TRAVELLER OR OTHER THIRD PARTY.

Limitation Of Liability

YOU ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ENTIRE RISK ARISING OUT OF YOUR ACCESS TO AND USE OF THE SITE, APPLICATION, SERVICES AND CONTENT, YOUR LISTING OR BOOKING OF ANY LISTINGS VIA THE SITE, APPLICATION AND SERVICES AND ANY CONTACT YOU HAVE WITH OTHER USERS OF COLLARFOLK WHETHER IN PERSON OR ONLINE REMAINS WITH YOU. NEITHER COLLARFOLK NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SITE, APPLICATION, SERVICES, WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA OR LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE OR THE COST OF SUBSTITUTE PRODUCTS OR SERVICES, OR FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY OR EMOTIONAL DISTRESS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, FROM THE USE OF OR INABILITY TO USE THE SITE, APPLICATION, SERVICES OR COLLECTIVE CONTENT, FROM ANY COMMUNICATIONS, INTERACTIONS OR MEETINGS WITH OTHER USERS OF THE SITE, APPLICATION, OR SERVICES OR OTHER PERSONS WITH WHOM YOU COMMUNICATE OR INTERACT AS A RESULT OF YOUR USE OF THE SITE, APPLICATION, SERVICES OR FROM YOUR LISTING OR BOOKING OF ANY LISTING VIA THE SITE, APPLICATION AND SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT COLLARFOLK HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

Indemnification

1. You agree to release, defend, indemnify, and hold Collarfolk and its affiliates and suppliers, and their officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (a) your access to or use of the Site, Application, Services, or Collective Content or your violation of these Terms; (b) your Member Content; (c) your (i) interaction with any Member, (ii) booking of a Listing, (iii) creation of a Listing or (iv) the use, condition or booking of a Listing by you, including, but not limited to any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of a booking or use of a Listing.

Entire Agreement

1. These Terms constitute the entire and exclusive understanding and agreement between Collarfolk and you regarding the Site, Application, Services, Content, and any bookings or Listings made via the Site, Application and Services, and these Terms supersede and replace any and all prior oral or written understandings or agreements between Collarfolk and you regarding bookings or listings, the Site, Application and Services.

Controlling Law and Jurisdiction.

Supplier and Traveller shall comply with all the applicable laws extending to but not limiting to Information and Technology Act, 2000 as amended by the Information Technology (Amendment) Act 2008, Prevention of Money Laundering Act, 2002 and the Rules, Statutes, Ordinances and Regulations (including, but not limited to Sales Tax/VAT, Income Tax, Service Tax, Local Levies and the rules made there under), Income Tax Act, 1961 and the rules made there under.
This site is controlled and operated by Collarfolk from its offices within the State of New Delhi, India. The laws applicable to the interpretation of these Terms shall be the laws of the India. If any provision within these Terms is held to be invalid or unenforceable, such provision shall be struck and all remaining provisions shall be enforced.

Dispute Resolution

You agree that any action at law arising out of or relating to these Terms shall be referred to Arbitration. Any dispute of any nature whatsoever or regarding to any right, liability, act or omission or account of any parties hereto arising out of or in relation to this Agreement shall be referred to the Sole Arbitrator. The Sole Arbitrator shall be appointed by Ms. Rukmini Vaish, Sole Proprietor, M/s Collarfolk. The parties shall not be entitled to raise any objection to any such Arbitrator on any ground whatsoever. It is also the term of this Agreement that no other person other than the one appointed by Ms. Rukmini Vaish shall as act an Arbitrator. The Award of the Arbitrator shall be final, conclusive and binding on all parties to the Agreement, subject to the provisions of the Arbitration and Conciliation Act, 1996, or any statutory modifications/amendments or re enactment thereof and the rules made there under and for the time being in force shall apply to the Arbitration proceedings.
The Award shall be made in writing. The place of Arbitration shall be New Delhi. The language to be used in the arbitral proceedings shall be English. Each party shall bear the cost of preparing and presenting its own case, and the cost of arbitration , including fees and expenses of the arbitrator, shall be shared equally by the parties unless the arbitration award otherwise provides.
Subject to the dispute resolution provisions, the Courts of law located in New Delhi shall have exclusive jurisdiction of any matter that may arise out of or in relation to this Agreement.

Travel Companion Information: When you make a reservation for someone else through this Site or any App, we will request personal information and travel preferences about that individual. You should obtain the consent of other individuals prior to providing us with their personal information and travel preferences, as any access to view or change their information will be available only through your account.

Information from Other Sources: We also may periodically lawfully obtain both personal and non-personal information about you from affiliated entities, business partners and other independent third-party sources and add it to our account information. Examples of information we may receive include: updated delivery and address information, purchase history, demographic information and automatic information. We automatically collect some information about your computer when you visit this Site. For example, we will collect your IP address, Web browser software (such as Firefox, Safari, or Internet Explorer), and referring website. + Each Mobile App will also send us error-reporting information in the event that it crashes or hangs. This enables us to investigate the error and to improve the stability of the Mobile App for future releases. Refunds

1. Refunded amounts are generally returned within ten (10) business days; however, the length of time required for the funds to be credited to your account is determined by your financial institution. Collarfolk.com has no obligation to issue refunds if: (i) Collarfolk.com. received payment ninety (90) or more days prior to our receipt of the refund request for a booking transaction; (ii) the purchase requires more than one refund or credit; (iii) in response to a disputed booking appearing on your statement from your financial institution, your financial institution issues you a refund for the disputed booking transaction and sends Collarfolk.com, a charge back on the transaction (a charge back reverses the payment you made to Collarfolk.com, for the refunded transaction); (iv) the booking is for non refundable travel products or services; (v) you cannot provide us with full and accurate information required to complete the refund or credit; (vi) the refund request has already processed through __________but has not yet applied to the originating source of the payment; (vii) the refund request directs Collarfolk.com, to issue the refund to a different financial institution than the source where the original payment was received; or (viii) Collarfolk.com, did not receive the payment for which the refund request is made due to force majeure or other causes beyond our direct control.

In the event a refund cannot be handled within standard refund protocols or to process a refund after 90 days, you may be asked to supply additional information and to provide documentation of the original charge. How The Site Works

5.1. The Site, Application and Services can be used to facilitate the booking of Listings including hotels, resorts and other accommodations various services and products for your pets. You may view the Listings as an unregistered visitor to the Site and Application; however, if you wish to book a Listing or create a Listing, you must first register to create a Collarfolk Account.
5.2. As stated above, Collarfolk makes available a platform or marketplace with related technology for Travellers to find a suitable pet friendly hotel and pet friendly products and services. Collarfolk is not a Supplier or operator of Listings, including, but not limited to, hotel rooms, motel rooms, other lodgings or accommodations, products or services and Collarfolk does not own, sell, resell, furnish, provide, rent, re-rent, manage and/or control listings, including, but not limited to, hotel rooms, motel rooms, other lodgings or accommodations or transportation or travel services or products or other services. Collarfolk’s responsibility is limited to: (i) facilitating the availability of the Site, Application and Services and (ii) serving as the limited agent of each Supplier for the purpose of accepting payments from Travellers on behalf of the Supplier. Similarly, Collarfolk is not a contracting agent or representative of any Supplier. Instead, Collarfolks’ role is solely to facilitate the availability of the Site, Application and Services for Travellers and to provide services related thereto.
5.3. PLEASE NOTE THAT, AS STATED ABOVE, THE SITE, APPLICATION AND SERVICES ARE INTENDED TO BE USED TO FACILITATE THE BOOKING OF LISTINGS. COLLARFOLK CANNOT AND DOES NOT CONTROL THE CONTENT CONTAINED IN ANY LISTINGS AND THE CONDITION, LEGALITY OR SUITABILITY OF ANY LISTINGS. COLLARFOLK IS NOT RESPONSIBLE FOR AND DISCLAIMS ANY AND ALL LIABILITY RELATED TO ANY AND ALL LISTINGS. ACCORDINGLY, ANY BOOKINGS WILL BE MADE AT THE TRAVELLER’S OWN RISK.

Account Registration

6.1. In order to access certain features of the Site and Application, and to book or create a Listing, you must register to create a Collarfolk Account and become a Member. You may register to join the Services directly via the Site or Application or as described in this section.

6.2. You can also register to join by logging into your account with certain third party social networking sites (including, but not limited to, Facebook); each such account, a Third Party Account, via our Site or Application, as described below. As part of the functionality of the Site, Application and Services, you may link your Collarfolk Account with Third Party Accounts, by either: (i) providing your Third Party Account login information to Collarfolk through the Site, Services or Application; or (ii) allowing Collarfolk to access your Third Party Account, as is permitted under the applicable terms and conditions that govern your use of each Third Party Account. You represent that you are entitled to disclose your Third Party Account login information to Collarfolk and/or grant Collarfolk access to your Third Party Account (including, but not limited to, for use for the purposes described herein), without breach by you of any of the terms and conditions that govern your use of the applicable Third Party Account and without obligating Collarfolk to pay any fees or making Collarfolk subject to any usage limitations imposed by such third party service providers. By granting Collarfolk access to any Third Party Accounts, you understand that Collarfolk will access, make available and store (if applicable) any Content that you have provided to and stored in your Third Party Account so that it is available on and through the Site, Services and Application via your Collarfolk Account and Collarfolk Account profile page. Depending on the Third Party Accounts you choose and subject to the privacy settings that you have set in such Third Party Accounts, personally identifiable information that you post to your Third Party Accounts will be available on and through your Collarfolk Account on the Site, Services and Application. Please note that if a Third Party Account or associated service becomes unavailable or Collarfolk’ access to such Third Party Account is terminated by the third party service provider, then Content will no longer be available on and through the Site, Services and Application. You have the ability to disable the connection between your Collarfolk Account and your Third Party Accounts, at any time, by accessing the “Settings” section of the Site and Application. PLEASE NOTE THAT YOUR RELATIONSHIP WITH THE THIRD PARTY SERVICE PROVIDERS ASSOCIATED WITH YOUR THIRD PARTY ACCOUNTS IS GOVERNED SOLELY BY YOUR AGREEMENT(S) WITH SUCH THIRD PARTY SERVICE PROVIDERS.
6.3. We will create your Collarfolk Account and your Collarfolk Account profile page for your use of the Site and Application based upon the personal information you provide to us. You may not have more than one (1) active Collarfolk Account. You agree to provide accurate, current and complete information during the registration process and to update such information to keep it accurate, current and complete. Collarfolk reserves the right to suspend or terminate your Collarfolk Account and your access to the Site, Application and Services if you create more than one (1) Collarfolk Account or if any information provided during the registration process or thereafter proves to be inaccurate, not current or incomplete. You are responsible for safeguarding your password. You agree that you will not disclose your password to any third party and that you will take sole responsibility for any activities or actions under your Collarfolk Account, whether or not you have authorized such activities or actions. You will immediately notify Collarfolk of any unauthorized use of your Collarfolk Account.

SUPPLIER TERMS

YOU ACKNOWLEDGE AND AGREE THAT, BY POSTING A LISTING OR OTHERWISE USING THE SITE, APPLICATION OR SERVICES AS A SUPPLIER, YOU ARE INDICATING THAT YOU HAVE READ, AND THAT YOU UNDERSTAND AND AGREE TO BE BOUND BY, THESE COLLARFOLK SUPPLIER TERMS. If you accept or agree to these Collarfolk Supplier Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Collarfolk Supplier Terms and, “I”, “you” and “your” will refer and apply to the Supplier, company or its other legal entity. YOU MUST COMPLY WITH ALL OF THE REQUIREMENTS AND CONDITIONS IN THE COLLARFOLK SUPPLIER TERMS.

 General Terms & Conditions

1.1. Collarfolk Petservices Private Limited (hereafter referred to as “Collarfolk.com”, “we”, “us”, or “our”) is a sole proprietorship having its registered office at 90/4 Malviya Nagar, Basement, New Delhi 110017, and “I”, “you” and “your” refers to the “Suppliers” creating a Listing of your hotel, resort, apartment, accommodation or any other location, products or other services with Collarfolk including the Site, Application and Services. Collarfolk aims to produce an informative website containing information on pet friendly hotels, travel destinations and a range of products and services for your pet. Collarfolk provides an online platform that connects Travellers with Suppliers who have pet friendly vacation properties offered for short term lets of less than 60 days and also information regarding a wide range of products and services for your pet (collectively, the “Listing”), which Services are accessible at www.Collarfolk.com and any other websites through which Collarfolk makes the Services available (collectively, the “Site”) and as an application for mobile devices (the “Application”). Collarfolk aims to produce an informative Site containing information on pet friendly hotels, travel destinations and a range of products and services for travellers with pets.

1.2. This Site is offered to you and is conditioned on your acceptance without modification of the terms, conditions and notices contained herein as they exist at the time the listing is made. By creating a listing on Collarfolk.com, using the Site and Application, you agree to comply with and be legally bound by the terms and conditions of these Supplier Terms (“Terms”). These Terms govern your access to and use of the Site, Application and Services and all Collective Content, and constitute a binding legal agreement between you and Collarfolk. Please read carefully these Terms and our Privacy Policy, and which is incorporated by reference into these Terms. If you do not agree to these Terms, you have no right to obtain information from or otherwise continue using the Site or Application. Failure to use the Site and Application in accordance with these Terms may subject you to civil and criminal penalties.

1.3. Collarfolk may revise these Supplier Terms at any time by posting an updated version to this web page. You should visit this page periodically to view the most current Supplier Terms because they are binding on you.

1.4. The site, application and services comprise an online platform through which suppliers may create listings and travellers may learn about and book such listings. You understand and agree that Collarfolk.com is not a party to any agreements entered into between suppliers and travellers, nor is Collarfolk.com a real estate broker, agent or insurer. Collarfolk.com has no control over the conduct of suppliers, travellers and other users of the site, application and services or any listings, and disclaims all liability in this regard.

Listings And Interaction With Suppliers

2.1. Suppliers are entirely responsible for all of the information, including images, text and other content, relating to the Listings including but not limited to the accommodations, products they offer, for updating them and ensuring (where relevant) that they are correctly translated.

2.2. If a Traveller finds a Listing in which they are interested, they can send an information request to the Supplier an enquiry stating their surname, e-mail address and telephone number, along with any requested information.

2.3. The Traveller will receive a confirmation from Collarfolk.com once an enquiry has been sent to the Supplier.

2.4. The Supplier will send the response to the query to Collarfolk which shall be then forwarded as is without any modification to the concerned Traveller.

Definitions

3.1 “Site”: means an informative website or an online portal listing information related to pet friendly resorts, properties, apartments, accommodations, pet friendly products and offers, information on nearby veterinary clinics and hospitals, information on available ambulances, pet salons and everything and anything displayed or listed on CollarFolk.com by a supplier.

3.2 “Application”: is defined as a downloadable CollarFolk program or tool on devices for business.

3.3 “Terms”: refers to an expression or clauses pertaining to usage of Collarfolk site, services and applications.

3.4″Content”: means all text, graphics, images, music, software (excluding the Application), audio, video, information or other materials that Collarfolk makes available through the Site, Application, or Listings, including any Content licensed from a third party and member Content.
3.5 “Traveller”: means a User/guest who requests a booking of a Listing via the Site and who utilises the services listed on the Application or site, or a User who stays at a Listing and buys products and services and who is not the Supplier for such Listing.
3.6 “Pets”: includes all dogs, cats and any other domestic pets.
3.7 “Supplier” means a Supplier or any individual or company or any entity which creates a Listing via the Site and Application.
3.8 “Listing” means services including but not limited to pet friendly hotels, resorts, properties, apartments, accommodations, pet friendly products and offers, information on nearby veterinary clinics and hospitals, information on available ambulances, pet salons and everything and anything and all services displayed or listed on the Site CollarFolk.com by a Supplier as available for booking via the Site, Application, and Services.

3.9 “Member” means a person who completes Collarfolk.com account registration process, including, but not limited to Suppliers and Travellers.

3.10 “Member Content” means all Content that a Member posts, uploads, publishes, submits or transmits to be made available through the Site, Application or Listings.

3.11 “Parties” refers to collectively Collarfolk and the Traveller/member/third party using the services and/or visiting the site and /or App of Collarfolk.

3.12. “Tax” means any sales taxes, service taxes, additional cess or surcharge, value added taxes (VAT), goods and services taxes (GST) and other similar municipal, state and federal indirect or other withholding and personal or corporate income taxes. Certain areas of the Site and Application (and your access to or use of certain aspects of the Services or Collective Content) may have different terms and conditions posted or may require you to agree with and accept additional terms and conditions. If there is a conflict between these Terms and terms and conditions posted for a specific area of the Site, Application, Listings, the latter terms and conditions will take precedence with respect to your use of or access to that area of the Site, Application, Listings, or Content.

Security Deposit

4.1. Collarfolk advises its Suppliers to include security deposits in their Listings or take a copy of the credit card of the Traveller on their arrival. Each Listing must describe whether a Security Deposit is required. If a Security Deposit is included in a Listing for a confirmed booking, the Supplier agrees to collect the Security Deposit at the time of check-in by the Traveller. The Supplier undertakes to return/ refund such Security Deposit collected at the time of check-out, net of claims, if any.
4.2. Collarfolk does not undertake to collect such Security Deposit from the Traveller, on behalf of the Supplier and is not responsible for refund of such amounts back to the Traveller, and disclaims any and all liability in this regard. Collarfolk is not responsible for administering or accepting any claims by Suppliers related to Security Deposits, and disclaims any and all liability in this regard.

5. Service Fees

5.1. In consideration for providing the Services, Collarfolk collects service fees from Suppliers and Travellers. Service Fees are made up of two components: (i) Traveller Fees and (ii) a fee that is charged to the Supplier based upon a percentage of the amount of the Accommodation Fees and Cleaning charges. Where applicable, Taxes may also be charged in addition to the Supplier Fees. Supplier Fees are deducted from the Accommodation Fees before remitting the Accommodation Fees to the Supplier, within 24 hours of when the Traveller arrives at the applicable Listing. Traveller Fees are, as noted above, included in the Total Fees.
5.2. Balances will be remitted by Collarfolk to Suppliers via cheque, direct deposit or other payment methods described on the Site or via the Application, in Indian Rupees (“INR”), depending upon the selections the Supplier makes via the Site, Application and Services. Except as otherwise provided herein, Service Fees are non-refundable.

6. No Endorsement

6.1. Collarfolk does not endorse any Members, Travellers or any Listings. In addition, although these Terms require Members and Travellers to provide accurate information, we do not attempt to confirm, and do not confirm, any Traveller’s or Member’s purported identity. The supplier is responsible for determining the identity and suitability of others who you contact via the Site, Application and Services.
6.2. By using the Site, Application or Services, you agree that any legal remedy or liability that you seek to obtain for actions or omissions of other Members or Travellers or their pets or other third parties will be limited to a claim against the particular Traveller(s) or Member(s) or other third parties who caused you harm and you agree not to attempt to impose liability on, or seek any legal remedy from Collarfolk with respect to such actions or omissions.

7. Damage To Listings

7.1. A Traveller is responsible for leaving the Listing in the condition as it was at arrival. The Traveller acknowledges and agrees that, as a Traveller, they are responsible for their own acts and omissions and are also responsible for the acts and omissions of any individuals, pets who they invite to, or otherwise provide access to, the Listing.
7.2. In the event that a Supplier claims otherwise and provides evidence of damage, including but not limited to, photographs, the traveller agrees to pay the cost of replacing the damaged items with equivalent items. The Traveller agrees that the cost of any damage to the listing maybe deducted by the Supplier from the security deposit or the credit card of the Traveller on the file of the Supplier. If the Supplier is unable to charge the credit card on file or otherwise collect payment from traveller, the traveller agrees to remit payment for any damage to the Listing to the applicable Supplier.
7.3. Collarfolk assumes no liability for any acts and omissions of the Traveller.

8. Limitation Of Liability

8.1. YOU ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ENTIRE RISK ARISING OUT OF YOUR ACCESS TO AND USE OF THE SITE, APPLICATION, SERVICES AND CONTENT, YOUR LISTING OR BOOKING OF ANY LISTINGS VIA THE SITE, APPLICATION AND SERVICES AND ANY CONTACT YOU HAVE WITH OTHER USERS OF COLLARFOLK WHETHER IN PERSON OR ONLINE REMAINS WITH YOU. NEITHER COLLARFOLK NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SITE, APPLICATION, SERVICES, WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA OR LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE OR THE COST OF SUBSTITUTE PRODUCTS OR SERVICES, OR FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY OR EMOTIONAL DISTRESS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, FROM THE USE OF OR INABILITY TO USE THE SITE, APPLICATION, SERVICES OR CONTENT, FROM ANY COMMUNICATIONS, INTERACTIONS OR MEETINGS WITH OTHER PERSONS OR USERS OF THE SITE, APPLICATION, OR SERVICES.

Responsibilities Of Supplier

9.1 Supplier Service Assurance
The supplier by creating a listing and using Collarfolk.com , including the Site, application and services undertakes to the following minimum quality standards in order to protect the interests of the Travellers:
9.1.1. Accuracy
The photos, pet policy, list of amenities and description of the Listing are correct. Directions and landmarks to reach the Listing are precise and easy to follow. The Listing rules are clear and easy to understand.
9.1.2. Calendar update
The Suppliers calendar must be accurately updated to reflect when the Listing will be available.
9.1.3. Responsiveness
The Supplier undertakes to booking requests/specific queries of the Traveller within the 24 hour time-frame.
9.1.4. Commitment
Before accepting a reservation, the Supplier must ensure that he can keep the commitment and avoid cancellation. If however, a cancellation is unavoidable, the Supplier must make every effort to provide an alternative Listing that meets similar or better quality standards.
9.1.5. Communication
If the Supplier has any specific house rules, the Supplier shall ensure that the same is communicated to the Traveller well in advance. At the time of check-in, the Supplier or his representative is present to hand-over the keys, give the Traveller a tour of the listing and acquaint him/her to the house rules, appliances and amenities.
9.1.6. Support
During the stay, the Supplier or his representative must be available to sort out any issue(s) that may arise.
9.1.7. Courtesy
The Supplier must always treat his Travellers with utmost courtesy – before, during and after their stay.

9.2. Quality standards for the Listing
The supplier undertakes to maintain a clean and safe environment for the Travellers so that they enjoy their time spent, choose to visit again and recommend the Listing to their friends and family. The Supplier further undertakes:
9.2.1. Cleanliness
To ensure that the Listing is cleaned before the Travellers arrive. To keep fresh linen, towels and other accessories ready and clean the bathrooms. To clean the Listing and provide fresh bedding at regular intervals, as specified in the Listing.
9.2.2. Comfort
The Listed accommodation is well ventilated. Air conditioners, heaters, showers, hot water geysers, television and other appliances, if mentioned as available in the Listing, are functional. The Supplier shall ensure that the Travellers are made aware of how to use these appliances. There are instructions for usage of appliances where necessary.
9.2.3. Safety
The Supplier certifies that the Listing is safe – there are no exposed wirings, electric hazards, pests or vermin. The doors, windows and locks are functional. There is a handy first-aid kit, fire extinguisher and list of emergency services. The Listing is child-proof and safe, especially whilst hosting families or elderly Travellers.
9.2.4. Accessibility
Access code or keys for the Listing are easily available to the Traveller for convenient accessibility.
9.2.5. Appliances
All the amenities that have been mentioned in the Listing description are available in working condition and safe to use.
9.3. Neighbourhood obligations
The Supplier agrees and certifies that the Supplier is mindful of his neighbours and neighbourhood, and respect their needs and concerns. The Supplier undertakes :
9.3.1. Building Rules
To inform building’s common area rules to the Traveller – like usage of pool, gym, park area, etc. To remind Travellers not to bother neighbours (.eg, by knocking on their doors or ringing their bells very late at night).
9.3.2. Smoking
If the Supplier does not allow smoking, the Supplier must mention it in his Listing Description and inform the Travellers and tell them about the nearest smoking area. If I allow smoking, I ensure that I have ashtrays available for my Travellers.
9.3.3. Parking
I relay parking rules for my building and neighbourhood to my Travellers.
9.3.4 Noise
I remind Travellers about keeping noise down. I am mindful of my decision to allow pets or parties. I ensure that my Travellers are clear about them inviting other Travellers.
9.3.5 Pets
If I allow pets, I ensure that Travellers are educated about the pet policy, society rules and location of the closest animal friendly parks.

9.4. Local rules, regulations and necessary approvals
The Supplier undertakes that :
9.4.1. My Listing is in adherence to local and national laws.
9.4.2 I have taken necessary approvals like permission from housing societies, Resident Welfare Association (RWA) and/or local authorities. The approvals I receive ensure that my Travellers don’t get unnecessarily hassled by others.
9.4.3 As required by local authorities (especially Police), I keep records of Travellers and their stay details. I submit the same to the Police as well.
9.4.4. If I share the apartment with some friends, I am mindful of their needs and keep them informed.
9.4.5. My Listing does not breach any agreements that I have entered into with any third parties.
9.4.6. My Listing does not breach any child labour norms.
9.5. Guide and support
As a local, the Traveller could look up to the Supplier to provide guidance and support to have a better experience of the location. The Supplier agrees and undertakes to keep city guides and maps, phone numbers to call a taxi/guide, order-in menus of eating places close-by and emergency service contact numbers available at the Listing.
9.6. Insurance
The Supplier understands that it is in his best interest to keep away and/or insure valuables (like expensive paintings, artefacts, cash, expensive electronic items, jewellery, etc.), within the Accommodation. The Supplier undertakes to take special care, when hosting families with small children. The supplier undertakes ensure that his Listings and valuables are adequately insured.
9.7. Taxes
The Supplier undertakes that:
9.7.1 I ensure that I am complying with any relevant tax laws that apply to my Listing and/or amenities provided within the Listing. This may include municipal taxes, property taxes, gram panchayat taxes, hosting taxes, service tax, Value Added Tax (VAT), income tax or others.
9.7.2. I ensure that all taxes, duties, levies and other dues to be paid by the Travellers are included in the Listing tariff.
9.7.3. I will ensure that if there is any other tax payable by the Traveller, the same will be mentioned in the Listing.
9.8. Failure to uphold the Supplier Service Assurance
Material non-adherence of any of these conditions, at the sole discretion of Collarfolk, could make my Traveller eligible to a refund. I understand that I may also be subject to some or all of the below consequences* :
9.8.1. Negatively impacted Listing ranking
9.8.2. Negative reviews indicating travel issues
9.8.3. Administrative fines or fees
9.8.4. Cancellation of future bookings
9.8.5. Suspension/Permanent removal of my Listing(s) from the site
9.8.6. Permanent removal of my account from the site

10. Controlling Law and Jurisdiction.

10.1. Supplier and Traveller shall comply with all the applicable laws extending to but not limiting to The Information and Technology Act, 2000 as amended by the Information Technology (Amendment) Act 2008, Prevention of Money Laundering Act, 2002 and the rules made thereunder, Foreign Contribution Regulation Act, 1976, Statutes, Ordinances and Regulations (including, but not limited to Sales Tax/VAT, Income Tax, Service Tax, Local Levies and the rules made there under), Income Tax Act, 1961 and the rules made there under.
10.2. This site is controlled and operated by Collarfolk from its offices within the State of New Delhi, India. The laws applicable to the interpretation of these Terms shall be the laws of the India. If any provision within these Terms is held to be invalid or unenforceable, such provision shall be struck and all remaining provisions shall be enforced.

11. Dispute Resolution

11.1. You agree that any action at law arising out of or relating to these Terms shall be referred to Arbitration. Any dispute of any nature whatsoever or regarding to any right, liability, act or omission or account of any “Parties” hereto arising out of or in relation to this Agreement shall be referred to the Sole Arbitrator. The Sole Arbitrator shall be appointed by Ms. Rukmini Vaish, Sole Proprietor, M/s Collarfolk. The parties shall not be entitled to raise any objection to any such Arbitrator on any ground whatsoever. It is also the term of this Agreement that no other person other than the one appointed by Ms. Rukmini Vaish shall as act an Arbitrator. The Award of the Arbitrator shall be final, conclusive and binding on all parties to the Agreement, subject to the provisions of the Arbitration and Conciliation Act, 1996, or any statutory modifications/amendments or re enactment thereof and the rules made there under and for the time being in force shall apply to the Arbitration proceedings.

11.2. The Award shall be made in writing. The place of Arbitration shall be New Delhi. The language to be used in the arbitral proceedings shall be English. Each party shall bear the cost of preparing and presenting its own case, and the cost of arbitration , including fees and expenses of the arbitrator, shall be shared equally by the parties unless the arbitration award otherwise provides.

11.3. Subject to the dispute resolution provisions, the Courts of law located in New Delhi shall have exclusive jurisdiction of any matter that may arise out of or in relation to this Agreement .

12. Disclaimer:

12.1. IF YOU CHOOSE TO USE THE SITE, APPLICATION AND SERVICES YOU DO SO AT YOUR SOLE RISK. YOU ACKNOWLEDGE AND AGREE THAT COLLARFOLK DOES NOT HAVE AN OBLIGATION TO CONDUCT BACKGROUND CHECKS ON ANY PERSON, INCLUDING, BUT NOT LIMITED TO, TRAVELLERS AND SUPPLIERS, BUT MAY CONDUCT SUCH BACKGROUND CHECKS IN ITS SOLE DISCRETION. THE SITE, APPLICATION AND SERVICES ARE PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, COLLARFOLK EXPLICITLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT OR NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. COLLARFOLK MAKES NO WARRANTY THAT THE SITE, APPLICATION AND SERVICES, WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS. COLLARFOLK MAKES NO WARRANTY REGARDING THE QUALITY OF ANY LISTINGS, THE SERVICES OR CONTENT OR THE ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS OR RELIABILITY OF ANY CONTENT OBTAINED THROUGH THE SITE, APPLICATION, SERVICES. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM COLLARFOLK OR THROUGH THE SITE, APPLICATION, SERVICES OR COLLECTIVE CONTENT, WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.
12.2. YOU UNDERSTAND THAT COLLARFOLK DOES NOT MAKE UNDERTAKE TO VERIFY THE STATEMENTS OF USERS OF THE SITE, APPLICATION OR SERVICES OR TO REVIEW OR VISIT ANY LISTINGS. COLLARFOLK MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OF USERS OF THE SITE, APPLICATION OR SERVICES OR THEIR COMPATIBILITY WITH ANY CURRENT OR FUTURE USERS OF THE SITE, APPLICATION OR SERVICES. YOU AGREE TO TAKE REASONABLE PRECAUTIONS IN ALL COMMUNICATIONS AND INTERACTIONS WITH OTHER USERS OF THE SITE, APPLICATION OR SERVICES AND WITH OTHER PERSONS WITH WHOM YOU COMMUNICATE OR INTERACT AS A RESULT OF YOUR USE OF THE SITE, APPLICATION OR SERVICES, INCLUDING, BUT NOT LIMITED TO, TRAVELLERS AND SUPPLIERS, PARTICULARLY IF YOU DECIDE TO MEET OFFLINE OR IN PERSON REGARDLESS OF WHETHER SUCH MEETINGS ARE ORGANIZED BY COLLARFOLK. NOTWITHSTANDING COLLARFOLK’ APPOINTMENT AS THE LIMITED AGENT OF THE SUPPLIERS FOR THE PURPOSE OF ACCEPTING PAYMENTS FROM TRAVELLERS ON BEHALF OF THE SUPPLIERS, COLLARFOLK EXPLICITLY DISCLAIMS ALL LIABILITY FOR ANY ACT OR OMISSION OF ANY TRAVELLER OR OTHER THIRD PARTY.

You can change or cancel your lodging booking either online under your Reservations when signed into your Collarfolk.com account, or by calling our customer services number +91 88 00 686 555.

You can change your Traveller name, bed type, special requests, accessibility options, room type, number of Travellers and travel dates at no charge to you by Collarfolk.com. Lodging suppliers may impose other change and/or cancellation fees. Charges vary by reservation, so please review your confirmation email for details.
You agree to pay any supplier required cancellation or change fees that you incur. In limited cases, some Listings do not permit changes to or cancellations of reservations after they are made, as indicated in the rules and restriction for the Listings reservation. You agree to abide by the terms and conditions imposed with respect to the Listing reservations. In the event that a Listing is unable to honour your booking, Collarfolk.com will not be liable for any cost incurred due to relocation.
If you do not show for the first night of your reservation but plan to check-in for subsequent nights in the reservation, you must confirm the reservation with Collarfolk.com no later than the original date of check-in to prevent cancellation of the whole booking. If you do not confirm the booking changes with Collarfolk.com the whole booking may be cancelled and refunds will only be due to you in line with the Rules and Restrictions of the particular property, as notified in the booking process. These terms and conditions may not be changed by any unauthorized person, including employees of Collarfolk.com.
